The consultant shall use desk studies and interviews to conduct a detailed analysis of the legal system affecting secured lending, including laws, supporting regulations, the registry system and supporting regulations, and the actual functioning of the registry.  The analysis will identify the strengths and weaknesses of the system, as well as any changes needed to align the system with international best practices (including the UNCITRAL Model Law on Secured Transactions) from the perspective of increased access to commercial credit for micro, small, and medium enterprises (MSMEs).  To the extent applicable, the consultant should also identify any gender biases or constraints inherent in the law or its current implementation. 

 

CANDIDATES MUST SUBMIT A WRITING SAMPLE WITH APPLICATION.

 

 

Responsibilities

The consultant shall provide a written report. The report should include:

  • An analysis setting forth specific strengths and weaknesses of the existing secured lending system.
  • Detailed, actionable recommendations for reforming and refining the existing secured lending system and practice to meet standards of best international best practice for increasing secured lending to MSMEs. For each recommended reform or change, the consultant shall: (1) identify the specific problem; (2) recommend the specific change needed to correct the problem; and (3) provide an explanation to assist reformers in understanding the issue addressed.
  • A comparison of the existing Law on Secured Transactions to the UNCITRAL Model Law on Secured Transactions. An appendix of relevant laws, regulations and practices should be included, along with a short, separate briefing paper describing the assignment and any concerns or issues raised during conduct of the assignment for USAID to be aware of.

Qualifications

  • 7+ years of experience in secured lending system analysis, design, and implementation.
  • Experience with Civil Law and Comparative Legal Systems.
  • Understanding of and experience with the UNCITRAL Model Law on Secured Transactions
  • Demonstrated knowledge of gender issues in access to finance
  • Superior analytical and critical thinking skills.
  • Strong written and oral communication skills.
  • Exceptional interpersonal, problem solving, and time management skills.
  • An advanced degree (or the equivalent experience) in law, finance, or other relevant field.
  • Willingness and ability to travel internationally.
  • Proficiency in Khmer or French.

 

Candidates without demonstrated secured lending experience will not be considered.
